1. Brokers Bridge's Role

Brokers Bridge doesn't provide financial or real estate advice and isn't a broker or lender. The platform is funded through membership fees and may display advertisements. The service explicitly doesn't act as a real estate agent, represent users in property transactions, or negotiate deals. Brokers Bridge assumes no responsibility for any result or consequence related directly or indirectly to any action or inaction that consumers take based on the Services.

2. Eligibility, Accounts and Registration

Users must be at least 18 years old and represent that they haven't been previously suspended from the service. Users warrant their registration complies with applicable laws and that they're licensed real estate professionals agreeing to follow local and state referral fee regulations. Account information must be kept accurate and current. Users are solely responsible for maintaining password confidentiality and all account activity.

3. Use of the Services; Restrictions

Brokers Bridge grants a non-exclusive, limited, revocable, personal, non-transferable license for personal use. Real estate professionals may use services for client-related activities if they have proper authorizations. Mobile app users may incur wireless charges. The platform may automatically update applications, and users consent to these updates.

4. Prohibited Use

Users cannot use information for loan decisions, reproduce or modify platform content, link to the service from non-real estate websites, remove copyright notices, use the service for resale purposes, engage in unlawful conduct, distribute spam, impersonate others, scrape data, upload malware, bypass security measures, or conduct automated queries.

5. Fees

Fees are non-refundable and charged in US dollars. The company provides advance notice of fee changes. Users authorize the payment processor to charge their specified payment method. Credit card pre-authorization may occur to verify validity and available funds.

6. User Materials

Users uploading content grant Brokers Bridge an irrevocable, perpetual, royalty-free worldwide license to use, modify, and distribute that content. Users warrant they own or have rights to all uploaded materials. Client contact information uploaded by agents won't be used by Brokers Bridge for other purposes. The platform isn't responsible for user-generated content but may remove or modify it.

7. Third Party/Linked Services/Sent Information

The platform includes links to third-party services and may transfer user information to external providers. Brokers Bridge doesn't endorse third parties or control their practices. Users are responsible for complying with third-party terms. Regarding financial products, users authorize information sharing with lenders for loan quotes. Brokers Bridge is not a Lender, loan originator, loan processor or underwriter and doesn't guarantee loan approval or terms.

8. Intellectual Property

Brokers Bridge owns the platform's user interfaces, design, code, and graphics, protected by intellectual property law. The company doesn't claim copyright over underlying real estate listing images or descriptions, which are subject to copyright owner permissions.

9. Feedback

Users granting feedback provide Brokers Bridge an unrestricted, perpetual, irrevocable, non-exclusive, fully-paid, royalty-free right to use suggestions for any purpose, including creating new products.

10. Claims of Copyright Infringement

Those claiming copyright violations should notify the copyright agent at info@brokersbridge.com with specific identification of copyrighted work, infringing material location, contact information, and signed verification of good-faith belief that use is unauthorized.

11. Termination/Changes to Agreement

Users may terminate accounts by contacting info@brokersbridge.com but remain liable for outstanding fees. Brokers Bridge may terminate accounts or suspend access at any time without notice. The company may alter or discontinue services. The company reserves rights to modify these terms with commercially reasonable notice of material changes.

12. Privacy Policy/Other Terms

Brokers Bridge handles personal information per its Privacy Policy, which is incorporated into these terms. Additional guidelines and rules for specific services are also incorporated.

13. Indemnification

Users indemnify Brokers Bridge from third-party claims arising from service access, breach of terms, law violations, disputes with other users, uploaded content, willful misconduct, or account misuse. Brokers Bridge does not act as a real estate broker and is not liable for the actions of any third party with relation to broker activities. The company isn't responsible for referral fee compliance between agents.

14. No Warranties

Services are provided "as is" with all faults. Brokers Bridge and its suppliers expressly disclaim any and all warranties or conditions, express, statutory and implied, including without limitation warranties or conditions of merchantability, fitness for a particular purpose, workmanlike effort, accuracy, title, quiet enjoyment, no encumbrances, no liens and non-infringement.

15. Limitation of Liability/Exclusive Remedy

Brokers Bridge assumes no liability for indirect, consequential, or punitive damages, errors, personal injury, property damage, unauthorized access, service interruptions, viruses, or user-generated content. Aggregate liability is limited to amounts paid to Brokers Bridge in the prior 12 months.

16. Choice of Law Disputes

These terms are governed by Florida law. Users submit to exclusive jurisdiction in Palm Beach County, Florida courts for disputes. Brokers Bridge makes no representation about service appropriateness in other locations.

17. General

Users agree to comply with export laws. The agreement may only be amended in writing by authorized representatives. Invalid provisions will be replaced with enforceable alternatives. Brokers Bridge may assign the agreement; users cannot. Failure to enforce against breaches doesn't waive future enforcement rights.

18. Consent to Communications

Users consent to electronic communications as described in the Privacy Policy. Notices and disclosures sent electronically satisfy legal requirements. Web forms and contact information may connect users with real estate professionals through third-party communication services. Calls may be recorded or monitored for quality assurance and customer service purposes.

19. Severability

If any provision is deemed unlawful or unenforceable, it's severed from the agreement without affecting remaining provisions' validity.

20. Notice to Apple Users

For iOS users, these terms are between the user and Brokers Bridge, not Apple. Apple has no obligation to furnish any maintenance or support services with respect to the Services. Apple isn't responsible for claims relating to the service or intellectual property infringement allegations.
